FDA Extends Comment Period on E-Liquid Regulation

SILVER SPRING, Md. — The Food and Drug Administration (FDA) is giving interested parties more time to weigh in on if and how the agency regulates e-liquids.

The FDA last week issued a 30-day extension for the comment period for the Advance Notice of Proposed Rulemaking (ANPRM) on Nicotine Exposure Warnings and Child-Resistant Packaging for Liquid Nicotine, Nicotine-Containing E-Liquid(s) and Other Tobacco Products.

The ANPRM, which the FDA announced earlier this summer, will now be open for comment until Sept. 30. The original 60-day public comment period began July 1, as CSNews Online previously reported.

According to the FDA, it is seeking comments, data, research and/or other information related to nicotine exposure warnings and child-resistant packaging for liquid nicotine, nicotine-containing e-liquid(s) and potentially for other tobacco products including but not limited to novel tobacco products such as dissolvables, lotions, gels and drinks. 

If the agency decides to issue a rule, the first step in the process is to issue a Notice of Proposed Rulemaking in the Federal Register, which gives the public an opportunity to comment on the proposal.
