ExxonMobil Settles FXX Logo Infringement Suit

HOUSTON — Exxon Mobil Corp. has dropped its trademark infringement lawsuit against the FXX Network following an out-of-court agreement with the network and its studio affiliates, including Twentieth Century Fox Film Corp. and Twenty-First Century Fox Inc., reported Bloomberg Business.

Settlement terms were not disclosed, but each side agreed to pay its own costs for the lawsuit, which ExxonMobil filed in October 2013, as CSNews Online previously reported.

ExxonMobil claimed that the FXX logo, which features an interlocking XX design, infringes on its own logo and that the network refused requests to change it.

Although a federal judge in Houston previously ruled that ExxonMobil could not prove it had suffered any actual damages from the network's use of the logo, the company could have pursued royalty claims at trial, according to the report.

The court received notification of the agreement on Oct. 16, three weeks before jury selection was scheduled to begin in the case of Exxon Mobil Corp. v. FX Network LLC, 4:13-02906, U.S. District Court, Southern District of Texas (Houston).
